The Transport (Scotland) Act 2005 enables the Scottish Ministers to set up various bodies concerned with the regulation of Scotland's Roads.

The most significant provision is the regulation of roadworks, setting up a register of roadworks, and creating the post of Scottish Roadworks Commissioner.
